Doe Prevails: Motion to Unseal Seals Fuller's Fate

Cyberlaw Clinic client John Doe and his anonymous speech rights have prevailed in the fight against Global Adhesives company H.B. Fuller. Fuller has withdrawn its subpoena to Yahoo seeking Doe's identity and has requested that the court dismiss Doe's appeal as moot. This is a great victory for our client and for free speech rights online.

This development is largely the result of our victory in the Motion to Unseal. When the California Court of Appeal granted the Motion to Unseal, it gave Fuller the option to designate materials in the record that it would rather see stricken than unsealed. Fuller has taken the court up on this offer, filing a request to have the declaration of CEO Michele Volpi stricken from the record, as well as all references to it from the briefs. That declaration provided most of the evidentiary basis that the trial court relied upon, so striking that from the record left Fuller with no ground to stand on.
