Today, Rep. Zoe Lofgren in conjunction with Reps. Ted Poe and Suzan DelBene announced a bill reforming the Electronic Communications Privacy Act (ECPA) to require law enforcement get a search warrant to compel disclosure of any stored communications content. The bill also includes a new section establishing a warrant requirement for geo-location data. The bill can be found here. A section by section summary explaining the amendments, including the new section on geo-location privacy is here. My redline of the relevant ECPA sections is here. First CFAA reform, then phone unlocking, now ECPA. Oh my.
