Some of the federal judges who have handled the most recent battles have expressed skepticism over X Corp.’s claims that it is standing on First Amendment principles. It may not be a coincidence that X has chosen to take up the fight in subpoenas targeting individuals championed by the right.
Still, some experts say that social media companies see more to this fight than political opportunism.
“Internet companies were born with this libertarian streak against the secrecy and volume of government legal process,” said Al Gidari, an expert on privacy law and electronic surveillance. “Call it a cultural aversion to government interference in online activities of users, but from the earliest days of the internet, providers sought to be as transparent as legally possible.”
