"It's unclear whether Bolleart was seeking protection under Section 230 of the federal Communications Decency Act, which offers liability in some cases to "interactive computer service" providers that allow third parties to post information. That may not be a strong argument, "not if what you're prosecuting him for is what [he as] the site operator has said and done," said Danielle Citron, a professor at the University of Maryland Francis King Carey School of Law and an expert in cybercrime issues. "The extortion charges, to me, are incredibly strong," she said."
