MoveOn vs. Swift Boat Veterans for "Truth"

The "liberal" New York Times denounces today both MoveOn.org and Swift Boat Veterans for [Truth] for being highly partisan groups outside campaign finance rules.  But isn't there a basic difference?  MoveOn may be opinionated and even fiesty, but it hasn't demonstrably lied.  I would have thought that distinction to be quite important.

Kerry's lawyers should file a defamation action immediately--but perhaps this would only bring more attention to the lies of the Swift Boat Veterans for "Truth."  Perhaps the better strategy is to wait till after the election: then file suit.  Such a suit--if the judge is willing to impose a very heavy fine--would help secure the electoral process against similar future perversions.
