If the Rosa Parks case did not convince you that the Right of Publicity can be a threat to democracy, here's another. Governater Arnold Schwartzenegger's publicity rights apparently belong not to him (directly) but to Oak Productions, Inc., which has now sent a threatening letter to the manufacturer of these bobble-head dolls >. Not to be confused with the Terminator doll, apparently licensed. The lawyer's letter explains that the governater only allows his image to be used to promote his films, ignoring his public figure status as an elected official. These lawyers must be busy! While the bobble head company continues to sell the Arnold dolls faster than ever, as the line between public affairs and entertainment continues to blur, the Right of Publicity becomes more and more dangerous.
