Windows code leak v. OSS?

A great point from Groklaw: What happens if elements of the Windows 2000 / NT4 code that was leaked last week somehow find their way (or seem to find their way) into Linux or other open-source projects? If that occurs, the litigation that could result could 1.) dwarf the SCO/IBM litigation, and 2.) severely constrain enterprise adoption of free software.
