Last week, RFID access device company HID Global got IOActive researcher Chris Paget to pull his talk from Black Hat DC because they claimed that demonstrating how to clone RFID cards violated their patents in card readers. Are they nuts? Unfortunately, IOActive, which probably holds several patents of its own and wants to look like an upstanding respecter of intellectual property rights, backed down and the talk went unmade. Supreme Court Holds Licensees in Good Standing May Seek Declaratory Judgment on Patent Validity, Enforceability, or Infringement

Petitioner MedImmune entered a patent license agreement with respondent Genentech in 1997. Under the arrangement, MedImmune agreed to pay royalties on sales of antibodies that would otherwise infringe an existing patent and a pending patent application. The patent application matured into Genentech's "Cabilly II" patent in 2001. Shortly after this application matured, Genentech indicated its belief that MedImmune's product Synagis was covered by the Cabilly II patent and its expectation that MedImmune would pay royalties on sales of Synagis under the 1997 agreement. Federal Circuit Rules That Explicit Assignment of Right to Sue without Transfer of All Substantial Patent Rights Is Insufficient

The court started its analysis by re-stating that there are three groups of parties that are entitled to bring a patent suit: (1) patentee, (2) successors in title to patentee, (3) transferee of all substantial rights in the patent for standing purposes. Internet at the next Ocean Tomo IP Auction

For the past year I’ve tracked the series of Ocean Tomo Patent / IP Auctions. The third in the series occurs April 2007 in Chicago, and I just received the catalog. The catalog is divided into topical sections, including Web-Based Services, Business Methods/Data Systems, and Digital and Home Media.

I attended the first Ocean Tomo auction and was impressed with what they’re trying to accomplish, and the standards they are setting. Clearly they’ve been ironing out the kinks and better calibrating expectations.
