Bryant Walker Smith is an assistant professor in the School of Law and (by courtesy) in the School of Engineering at the University of South Carolina. He is also an affiliate scholar at the Center for Internet and Society at Stanford Law School, an adjunct clinical professor at the University of Michigan Law School, a member of the US Department of Transportation's Advisory Committee on Automation in Transportation, the chair of the Emerging Technology Law Committee of the Transportation Research Board of the National Academies, the reporter to the Uniform Law Commission's Drafting Committee on Highly Automated Vehicles, the chair of the Planning Task Force for the On-Road Automated Vehicle Standards Committee of the Society of Automotive and Aerospace Engineers, a faculty affiliate of the Rule of Law Collaborative, and a member of the New York Bar.
Bryant's research focuses on issues of risk and trust in new technologies, especially automated driving systems, unmanned aerial systems, and other transportation technologies. As an internationally recognized expert on the law of driverless vehicles, Bryant taught the first-ever course on this topic (as well as the first course on hyperloops) and is regularly consulted by government, industry, and media. Before joining the University of South Carolina, Bryant led the legal aspects of automated driving program at Stanford University, clerked for the Hon. Evan J. Wallach at the United States Court of International Trade, and worked as a fellow at the European Bank for Reconstruction and Development. He holds both an LL.M. in International Legal Studies and a J.D. (cum laude) from New York University School of Law and a B.S. in civil engineering from the University of Wisconsin. Prior to his legal career, Bryant worked as a transportation engineer.
Following Uber’s fatal crash in Arizona, Governor Doug Ducey is attracting attention for what he did and did not do. This is not surprising; as I noted in 2016, Arizona's governor decided to embrace Uber’s vision, for better or for worse. This discussion, however, tends to elide the important question of his actual legal authority.

This 2014 law review article provides the most comprehensive discussion to date of whether so-called automated, autonomous, self-driving, or driverless vehicles can be lawfully sold and used on public roads in the United States. The short answer is that the computer direction of a motor vehicle’s steering, braking, and accelerating without real-time human input is probably legal. The long answer, contained in the article, provides a foundation for tailoring regulations and understanding liability issues related to these vehicles.
Is water a "product" subject to the World Trade Organization (WTO)’s General Agreement on Tariffs and Trade (GATT)? I argue that it is not, because the established, widespread, and consistent assertion by states of public ownership over their water resources through both municipal and international law (the "public-ownership consensus") precludes any reading of GATT that would fundamentally alter the unique status of those resources.
An effective climate regime must be global rather than merely international and must recognize the significant involvement of actors other than states. This Article first examines the role of statism in the existing international climate regime and challenges several assumptions that underlie the demand for the global South’s "meaningful participation" in that regime. It then demonstrates how the global South is already participating in a global climate regime through the activities of private economic actors from around the world.
As a contribution to the debate over market-based environmental regulation, this article examines the reaction of stakeholders to cap-and-trade programs proposed and/or implemented in the United States, the European Union, and the Netherlands for industrial emissions of certain pollutants. Those pollutants include nitrogen oxides (NOX), sulfur dioxide (SO2), mercury (Hg), and greenhouse gases such as carbon dioxide (CO2).

"Lyft’s acquisition of Motivate is merely one more step in the ride-hailing industry’s march toward increased dominance in the shared-vehicle market, whether that’s bikes or cars, said Bryant Walker Smith, an affiliate scholar at Stanford Law School’s Center for Internet and Society. In part, that’s a response to the changing nature of city living and the increasing desire from customers to have more choice and flexibility in the way they move around, he said.
"Both Vasquez and Uber could still face civil liability in the case, Uber for potentially negligent hiring, training and supervision, said Bryant Walker Smith, a University of South Carolina law professor who closely follows autonomous vehicles.
Vasquez could be charged criminally, and if there's evidence that Uber or its employees acted recklessly, then charges against them are possible, Smith said. But charges against the company are not likely, he added.
