Students will work with officials from the California State Office of Privacy Protection to create a self-help guide for people who have been the victims of identity theft. California law provides some remedies to victims who may be subject to false arrest due to warrants issued for others who commit crimes and give the victim’s identifying information to authorities. California Penal Code section 530.6 allows identity theft victims to petition for a judicial finding of factual innocence and enter their names in a state-wide database that authorities can consult to confirm claims of innocence/false arrest. The self-help guide will include detailed information explaining how to petition. Students will also undertake representation of victims, file and argue the 530.6 petitions on their behalf.
