EPIC v. NASA

The Electronic Privacy Information Center (EPIC) used the Freedom of Information Act (FOIA) to request NASA turn over all documents and correspondence regarding Northwest Airlines disclosure of passenger data to NASA. While releasing 37 pages of documents, NASA withheld an unknown number claiming they fell under exceptions to FOIA that permit agencies to (1) withhold documents that constitute inter-agency memoranda or letters and (2) withhold documents that contain trade secrets and commercial or financial information that is privileged. Students will represent EPIC in seeking a court order that NASA turn over any remaining documents relevant to the FOIA request.

NASA filed their reply brief today (Pesonen Declaration). Sarah Givan will argue the case on June 4, 2004 before Judge Whyte at 9 am.

EPIC Asks to Speed Up the Litigation

Today EPIC filed a Motion to Recalendar the case management conference and to set a briefing schedule so the litigation can commence. We also had to file an Application to Shorten Time, asking the Court to quickly rehear the recalendaring motion, rather than following the normal process allowed for most motions.

Today, the Clinic filed a complaint in the U.S. District Court for the Northern District of California. The case number is: C04-00296. It was assigned to District Court Judge Ronald M. Whyte and Magistrate Judge Patricia Trumbull (for discovery and preliminary motions).
