Bodo, excellent post. My $.02: I'll blame the criminalization of the read-write culture itself by way of strong IP. This threatens not only true theft (whatever we mean by that), but conversely could (and perhaps is) boomeranging around to create in the doctrine of "fair use" a presumed catch-all safety net that is ripe for abuse (and hence undermining) if not carefully tailored. Hope that was clear . . . And I like your phrase "individualization of the commonplace" . . .
