OPG and the Swarthmore student plaintiffs asked the District Court today to rule that Diebold had no legitimate claim that posting an email archive about electronic voting machines, or hosting a link to that archive, was copyright infringing. EFF has published its comments on the Intel LaGrande Technology Policy Draft. The paper raises several interesting points. Among other things, the paper stresses that a real opt-in technology is not a technology which can simply be turned on or off. Search engines are a crucial part of the Web’s architecture. They open the gates to the Web’s universe of information and operate as guides through the paths of the network. But what if the guide you are depending on is biased in what sites he will show you? That would indicate a flaw in the Web’s ideology of openness and informativeness.
