An Exercise in Pounding the table

For those of you sweating the outcome of OSYU v. Choudhury, here's the latest opus from Bikram's dream team in support of his motion for judgment on the pleadings.

In short, they ignore all OSYU's arguments based on well-settled 9th Circuit cases involving declaratory judgment suits in intellectual property cases. No longer claiming that OSYU's attorney Jim Harrison is a yoga instructor who wants to compete with Bikram, now their only argument is that OSYU does not really exist, based on their interpretation of California's corporate code. (OSYU's witnesses beg to differ.) It's sort of a corporate veil argument, except if you did pierce the veil you would find ... yoga instructors threatened directly by Bikram. This helps their standing argument how? Also, they would be much, much happier if Elizabeth Rader were not on the case. Always a sign I'm doing my job.
