Ryan Calo is an assistant professor at the University of Washington School of Law and a former research director at CIS. A nationally recognized expert in law and emerging technology, Ryan's work has appeared in the New York Times, the Wall Street Journal, NPR, Wired Magazine, and other news outlets. Ryan serves on several advisory committees, including the Electronic Frontier Foundation, the Electronic Privacy Information Center, and the Future of Privacy Forum. He co-chairs the American Bar Association Committee on Robotics and Artificial Intelligence and serves on the program committee of National Robotics Week.
As robots leave the factory and battlefield and enter our homes, hospitals, and skies, it is not clear who will come to regulate them. But we can begin to spot some interesting patterns. Students of this transformative technology should keep their eye on both the claims and disavowals of authority over robots by state and federal agencies. Each hold potential dangers for our civil liberties and for the future of robotics.
The Los Angeles Times quotes me over the weekend in its front page story about the use of a Predator B drone to catch a civilian suspect in North Dakota. In my comments, I allude to how the domestic use of drones may paradoxically help drag privacy law into the twenty-first century. Not many people in the legal academy study artificial intelligence or robotics. One fellow enthusiast, Kenneth Anderson at American University, posed a provocative question over at Volokh Conspiracy yesterday: will the Nobel Prize for literature ever go to a software engineer who writes a program that writes a novel?
What I like about Ken’s question is its basic plausibility. Software has already composed original music and helped invent a new type of toothbrush. It does the majority of stock trading. Software could one day write a book. A focus on the achievable is also what I find compelling about Larry Solum’s exploration of whether AI might serve as an executor of a trust or Ian Kerr’s discussion of the effects of software agents on commerce.
NO: It Is the Way to Kill Innovation

The year is 1910. Orville and Wilbur Wright are testing their plane and happen to fly hundreds of feet over a stretch of land you own. Could you sue them?
Technically, you could. In 1910, your property rights extended ad coelum et ad inferos—up to heaven and down to hell. Anyone who flew over your property without permission was trespassing.
I am a law professor who writes about robotics. I’m also a big Paolo Bacigalupi fan, particularly his breakout novel The Windup Girl involving an artificial girl. So for me, “Mika Model” was not entirely new territory. For all my familiarity with its themes, however, Bacigalupi’s story revealed an important connection in robotics law that had never before occurred to me.
"“I don’t see a privacy problem with leveraging cell towers,” says Ryan Calo, a law professor at the University of Washington, where he teaches a class on robotic law and policy. “If a centralised place is keeping track of these things, we would have some accountability. I don’t believe anybody thinks we should have anonymous drones the way we should have anonymous web surfing.”"

Only about eight states do have legislation limiting or prohibiting the use of drones for spying or surveillance. They are Arkansas, Mississippi, North Dakota, Indiana, Louisiana, North Carolina, Tennessee and Wisconsin.
"It's gonna take some time. Hopefully we'll be able to figure out the right balance with drones," says Calo."
"Because one thing we can’t overlook is that drones at the border can be invaluable. “Let’s not have a failure of imagination of how useful these things are,” Ryan Calo said to me recently. “What about drones that find other drones because people are sending crystal meth over the border?” he asked."

"“It’s a tenuous stretch of that provision to say that it also covers autonomous vehicle reports,” says Bryant Walker-Smith, a lawyer with the Center for Internet and Society at Stanford Law School. “I suspect this is a policy decision made within the DMV or perhaps by others within government that they do not want to expose companies to this kind of public scrutiny, or they want to encourage candor that might otherwise by stymied.”"
